3. Data Ownership and Use
You retain full ownership of all data and customer information you upload.
Review Nest acts solely as a data processor, using your data only to provide the Services.
We do not sell or use your data outside your account’s intended purpose.
You represent that you have the legal right and consent to upload and use all customer data.
4. Acceptable Use Policy
You agree not to use Review Nest for:
Spam or unsolicited communications
Fake, misleading, or incentivized reviews that violate platform rules (e.g., Google policies)
Harassment, abuse, or deceptive practices
Any activity that violates applicable laws or regulations
Violation may result in suspension or termination.
5. Compliance With Messaging Laws
You are solely responsible for complying with all applicable laws, including but not limited to:
TCPA
CAN-SPAM
GDPR / CCPA (if applicable)
Carrier and platform messaging policies
Review Nest is not liable for penalties resulting from misuse of messaging features.
6. Payments, Billing, and Refunds
Fees are charged based on your selected plan.
All payments are non-refundable unless stated otherwise in writing.
Failure to pay may result in suspension or termination.
Pricing may change with reasonable notice.
7. Free Trials and Promotions
Free trials are offered at our discretion.
Abuse of trials or promotions may result in immediate termination.
No guaranteed results are implied or promised.
8. No Guarantee of Results
Review Nest provides tools only. We do not guarantee:
A specific number of reviews
Ratings or rankings
Revenue or business growth
Results depend on customer behavior and third-party platforms.
9. Third-Party Services
We may integrate with third-party services (SMS providers, payment processors, analytics tools). We are not responsible for outages, delays, or policy changes caused by third parties.
10. Account Suspension and Termination
We may suspend or terminate your account if:
These Terms are violated
The platform is misused
Payments are not made
Upon termination, access to services and data may be removed according to our retention policies.
11. Limitation of Liability
To the maximum extent permitted by law:
Review Nest is not liable for indirect or consequential damages.
Our total liability shall not exceed the amount paid by you in the previous 30 days.
